What Is the T Visa?
The T Visa is a form of immigration protection available to survivors of human trafficking, including labor trafficking and sex trafficking. It was created to help individuals who have experienced exploitation obtain lawful status, find greater security, and build a more stable future in the United States.
Many survivors do not realize that what happened to them may qualify as human trafficking under U.S. immigration law. In fact, some of the strongest T Visa cases involve labor trafficking situations that victims never recognized as trafficking at the time.
For many survivors, the T Visa is more than an immigration benefit—it is an opportunity to move from survival toward safety, independence, and long-term stability.
Who May Qualify?
You may qualify for a T Visa if:
You were the victim of human trafficking, including labor trafficking or sex trafficking
You are present in the United States as a result of that trafficking
You have complied with reasonable requests from law enforcement, when required
You would suffer extreme hardship involving unusual and severe harm if required to leave the United States
Many people assume trafficking only applies to extreme situations involving physical captivity or organized criminal networks. That is not always the case.
You may have a viable T Visa case even if you were never physically restrained, never reported the trafficking, or continued working because you felt you had no realistic alternative.
What Does Labor Trafficking Look Like?
Labor trafficking often occurs when employers or recruiters use force, fraud, or coercion to obtain labor or services.
Examples may include:
Being recruited with false promises about a job, wages, or working conditions
Being paid significantly less than promised or not paid at all
Being threatened with deportation if you leave a job
Having your passport or identification documents taken away
Being required to work excessive hours without fair compensation
Being forced to live in employer-controlled housing
Being controlled through fear, manipulation, debt, threats, or abuse
This is not a complete list. Many survivors are surprised to learn that their experiences may qualify for protection under the T Visa program.
